KAYMAKS LIMITED (Company Nr.: 04773478 with Registered office at: 25 Sackvilee Street, London – Piccadilly, England, W1S 3AX, hereinafter reffered to as “we”, “us”, “our”, “KAYMAKS”) acts in terms of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter - GDPR) and Directive (EU) 2015/2366 of the European Parliament and of the Council of 25 November 2015 on payment services in the internal market, amending Directives 2002/65/EC, 2009/110/EC and 2013/36/EU and Regulation (EU) No 1093/2010, and repealing Directive 2007/64/EC.

This Privacy Policy is designed to advise you about the personal data that we collect and the purposes for which this personal data is being processed, used, maintained and disclosed.

Who we are?

KAYMAKS is a company providing money remittance in multiple countries, currencies and payment solutions with round-the-clock support.

What is personal data?

Personal data refers to any information relating to you or that can link to you.

What personal data we process?

Personal data is usually collected from you through our registration process when you request for our products and services. Data may also be obtained about you from third-party reference sources for verification purposes.

We may process any information that we receive from you. Such information may include the following personal data:

  2. Date of birth;
  3. Photo;
  4. ID document information;
  5. Address;
  6. Phone Number;
  7. E-mail address;
  8. IP address;
  9. Bank and bank account details.

By processing we mean everything we can do with this personal data such as collecting, recording, storing, adjusting, organising, using, disclosing, tranferring or deleting.

We do not process sensitive data relating to your health, ethnicity, religious, political beliefs, trade unions membership, genetic data, biometric data or data concerning a natural person´s sex life or sexual orientation.

We use personal data for the following purposes:

  1. To carry out transactions in the Money Remittance System (hereinafter reffered to as “MRS”);
  2. To analyse MRS and Agent network;
  3. To carry out regulatory purposes (such as tax, prevention of Money Laundering and/or Fraud and etc.);
  4. To provide you, with your prior permission, with information associated with our products and promotions;
  5. To carry out market research;
  6. To provide personalized service;
  7. Internal records Keeping in accordance with FCA regulation;
  8. To verify your details with National and Credit agency databases.

Data that we process for any other reason is anonymised or we remove as such of the personal information as possible.

Who we share your data with and why?

KAYMAKS entitites – we tranfer personal data across our branches for operational, regulatory or reporting issues to comply with certain laws, obligations, secure IT systems. We may also transfer personal data to our storage system or to process globally for more efficiency.

Agents – we share information to natural or legal person who acts on our behalf in providing payment services.

Government authorities – to comply with our regulatory obligations, we may disclose data to the revelant authorities, for example to prevent money laundering.

Financial institutions – tranferring the funds from a payer to payee, the transaction involves other financial institutions, banks or a specialised financial company. We may process payments through such other finacial institution.

Third party service providers – when we use other service providers, we only share personal data that is required for the particular task we involve the service provider for.

With you permission – Your information may also be used for other purpose for wich you give your permission or required by law.

In some cases, we are obliged by law to share your data with external parties, includig public authorities, regulators and supervisory bodies such as fraud protection agencies and the central banks of the countries where we operate, judicial/investigative authorities such as the police, police public prosecutors, courts and arbitration/mediation bodies on their express and legal requests, lawyers.

Cookies are small bit record-keeping information that we store in user’s computer/other equipment in order to associate and identify activity with user.

Right to rectification – user and/or client shall have the right to obtain from us the rectification of inaccurate personal data.

”Right to be forgotten” - user and/or client shall have the right to obtain from us the erasure of personal data.

Right to restriction of processing – user and/or client shall have the right to obtain restriction of processing where one of the following applies:

  1. The accuracy of the personal data is contested by the data subject, for a period enabling the KAYMAKS to verify the accuracy of the personal data;
  2. The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;
  3. The KYAMAKS no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims;
  4. The data subject has objected to processing.

Right of data portability - The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to KAYMAKS, in a structured, commonly used and machine-readable format and have the right to transmit those data to another person without hindrance from the KAYMASK to which the personal data have been provided.

Right to object - The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her, including profiling.

Automated individual decision-making, including profiling - The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her.

How long we keep your personal data

Once you are no longer our customer, agent, partner or somehow connected with us with other obligations, we will retain your personal information for a reasonable period, or as otherwise allowed or required by law.

Security of Personal Data processing

Taking into the account the state of art, scope and purposes of processing, we implemented appropriate technical and organisational measures to ensure a level of security appropriate to the risk of loss, misuse, unauthorized access, disclosure and alteration.

Technical and organisational security measures are reviewed from time to time in line with the legal and technical developments in order to ensure ongoing confidentiality, integrity, availability and resilience of processing systems and services.
